A little bit of history:
The first colonists mastering a New World have brought in it from Europe the death penalty practice as punishments. For the first time the death penalty on the American continent has taken place in the State of Virginia in 1608. The convict — captain George Kendall — has been charged of espionage for benefit of Spain. In 1612 the governor of the State of Virginia had been accepted the statute book, received the name «Divine, Moral and Martial Laws» which provided the death penalty even for insignificant offenses, for example such as grapes larceny. [ ] in a colony of the Massachusetts gulf the first execution has taken place in 1630, and in New York in 1665 the statute book named «Duke’s Laws» according to which the death penalty punished even «negation of true God» has been accepted.
From the XVIII-th century beginning in America the tendency to decrease in quantity of the death penalties is observed and there are movements of abolitionists (that is opponents of the death penalty as punishments for criminal activity). To the end of the century in the State of Pennsylvania the death penalty for all crimes, except murder of the first degree has been cancelled. In Civil war in the USA movement against the death penalty weak, having given way to movements for slavery cancellation.
During Civil war has extended across all America so-called «Lynch's courts», named so by name of the land owner from Virginia Charles Lynch who punished infringers of the law without court. Because lynching is not involved in the courts, but with local residents, who were execute guilty at their discretion, its impossible'to name this practice directly to concept "death penalty".
In first half XX th centuries movement of abolitionists has renewed, and support of the death penalty among the country population to 1960 has sharply decreased.
In 1972 on the death penalty the moratorium as it has been recognized the contradicting constitution of the country has been entered into the USA.
However in 1976 year the Supreme court of the USA has permitted all states to renew renew of death sentences. first execution after the moratorium has taken place only in 1982 in Texas.
